letters inclofit in the Lord Panmuir his pacquet, quhilk he fent to the Secretar, with a warrand for him and his good-fone Athy, for ratifeing of thair blensche infeftmentis latlie paft in Februar 1639. Item, a letter from me to the Erl Stirling, and within it a warrand to be paft his Majeftie, for ratificatioun in Parliament of my blenfche infeftment of Craighal and Kyninmonth, in Junij 1635. Item, a fignatour to Mr. Alexander my fone of the lands and mynes of Waterheid, vpoun Mr. James his refignatioun, to be paft his Majeftie's hand.

17 August 1639, Setterday.

This day the Affemblie, quhilk began at Edinburgh on Mononday the 12 August, clofit the point of Epifcopacie, and declarit it vnlawfull, and contrair to Godis word, to the vnfpeakabill joy of all them that feiris the Lord, and waittis for his falvatioun.

Item, this nycht fent a pacquet to the Erll of Stirling, advertising him heirof, and thairwith fending him a warrand to ratifie ane rycht of patronage of Tullibody in Parliament. Item, a warrand for ratifeing James Maxwell his infeftment of the patronage of Dirltoun, and containing a fuppreffioun of the abbacies of Dryburgh and Cambuskennell, and pryorie of Inchmahomo. Item, a letter to my fone Mr. Alexander, and ane other to James Levingstoun.

This day delyverit to the Lord Commiffioner a packett to the Erl Stirling, quhairin one to him from Lord Panmuir. Item, one from me, with the prefentatioun of Monecky to Mr. Henry Fithy, vpon the deceiß of Mr. John Durham, laft minifter; and in the end thairof my regrait of thir 3: (1.) That I never callit to be prefent; (2.) That S. L. at his elbo; (3.) That his fplen and outragious speeches my disgrace.

Item, this day the Lord Commiffioner afkit me concerning the 3 eftait of Parliament, quhilk I anfuerit in prefence of Erl Southesk and Lord Justice Clerk.

Item, thairefter I fpak with the Erll of Airth, &c.

21 Auguft 1639, Weddinfday.

Tutor of Calder.

This day Colin Campbell, Tutor of Calder, promifit to me zeirly thrie or Colin Campbell, four mairtis to attend to the Lard's affairs and his; and to begin at Mertimes nixt.

Item, he promifit to gif the feu-duety of Ylaw to Mr. George, to remayne Ylaw. in his hands; and he wes content that I fould tak it from Mr. George, vpon furety to repay it, if I gat him not to discharge.

25 Auguft 1639, Sounday.

This day, betuix allevin and tuelff befoir none, David Mccall deceffit. Item, fent letters to the Erl Stirling and my fone, anfuering the Erll his letter reffavit 24 Auguft, and complaining of my fone of not anfuering his, quhilk wer fent at one tyme.

This day the Parliament fencit be commiffiouns vnder his Majestie's Parliament. Quarter Seill, and continewit to the 30 of Auguft inftant, and this Court wes holdin in the New Parliament Houß.

The Parliament fencit, and ordanit to ryd to-morow; and this intimate Parliament. to the estates be a meafer and found of trompet.

This day my dauchter Margaret brocht to bed, and delyverit off ane man My dauchter Marchyld, for quhilk I bliffe the Lord; and gevin to Jean Cuningham, midwyff, 1 tuelf-pund piece. The bairne wes borne betuix 3 and 4 efternone.

This day Hary Hope went to Bruntiland, to schip to Newheavin; and I gave him for a takin 2 quadrupill piftolles of gold.

Item, this day the Maister of Berridaill deceiffit at Edinburgh, being heir attending the Generall Affemblie.

9 September 1639, Mononday.

The bairne baptisit This day the bairne baptifit in the Auld Kirk, efter the morning preiching, be Mr. William Colace; and the bairne namit Archibald. Witneffes, Archibald, Erl of Ergyll; Patrik Lyndfay, myself, Charles, Sir Thomas, James, Mr. Archibald Johnftoun, Mr. Alexander Colvill.

This day a letter fent to my fone, and within it to the Erll of Stirling, to tell them of the difput anent the 3 eftait, and vote in Parliament.

19 September 1639, Thursday.

This day Mufchet, fervitor to the Erl Airth, went to Court, and come and askit if I had my letters; and with him I sent a letter to my fone, and within it one to Mr. Levingstoun, in anfuer of his reffavit be me, about the lordfchip of Wauchtoun, in the matter of Beill, on 15 September instant. Item, 21 September, Setterday, Sir James Hay of Smeithfeild, Squyre of his Majeftie's Bodie, went to Court, and fent with him a letter to my fone, to be fchawin to Mr. Levingftoun and to the Squyre himself, that he may fchaw his Majeftie I haif loft popular applause.

22 September 1639, Sounday.

This day, about 3 in the morning, I calling to mynd the croce proceidings in Parliament, (quhairof I haif a large journall every day fince it fatt doun,) and the difficult and hard eftait quhairin the kirk and kingdome ftandis, did pour furth my heart in prayer and teiris to the Lord, and betuix the feir of judgement for fyn, and the expectatioun of pardoning mercie in respect of the glorious work alreadie done be the Lord in his Kirk; and

thairefter falling in a flumbering, I hard thir words, "My work is a perfyt work." The Lord perfyt it!

And vpon the morne, being Mononday, 23 September, betuix 4 and 5 in the morning, I being regraiting the greit difficulties of the ratificatioun of Godis treuth be the Parliament, be reffoun of the queftiounes movit be the barones anent the 3 Eftait, thir words cam to me, "I will do it in my awin way." For quhilk I bleffe the Lord, and belevis that the Lord will do it in his owin glorious way.

1 October 1639, Twyfday.

This day I reffavit letteris from the Erl Stirling, beiring he had acquaintit Erl Stirling. his Majeftie with the buffiness of the thrid Eftait.

Item, on 2 October writtin to the Erl Stirling, and als to my fone Mr. My sone Mr. Alexander, and within his one from my fone Mr. James, delyverit to William Leyth, fervitour to the Erl Mortoun, quho is to go poft to-morow, 3 October 1639.

3 October 1639, Thursday.

This day Mr. Ninian Bowfe maryit on Katharine Maccall, dochter to Mr. Niniane vmquhile Dauid M'call; and gevin ane gilt coup of 22 vnce, and ane filver coupe of 16 vnce.

5 October 1639.

Packet fent to Erl Stirling, quhairin a packet to him from the Lord Pan- Packett. muir. Item, one from me to James Levingstoun.

9 October.

This day I fpok the Erll of Lauderdaill, in the rowme above the Articles, Erl Lauderdaill. about 8 in the morning, (he being thair, with the Erl Southefk and Innerpeffer, on a Committee of the Blew Book, and I, with the Erl of Southefk, vpon the Act of Landflords in the North ;) and I defyrit to knaw if he wald pay the j merks and intref: And his anfuer wes, that he wald mak

the dyk of the faill; quhen the Erl Home payit him he wald pay me; or, if I defyr, he wald affigne me fo much of the Erll of Home's band. And then he askit, quhat I had done for the Erl Murray; and that he fould not if the Erl of Murray pay nott. To quhilk I anfuerit, that both he and the Counteß of Home had promifit. Item, I did of befoir remember him of his promise in the lobbie of the Eift Kirk, the tyme of the Generall Affemblie, in Auguft laft; quhair he said, " Manet irrevocabile verbum!"

This day, at 7 hours, I went to the Abbay at 7 hours in the morning; and thair the Commiffioner afkit my opinioun anent the act of Menfall Kirkis, quhilk I told in prefence of Sir Lues Steuart, and reportit to the Marques of Huntley firft, and then to the Lord Privie Seill; but quhen the matter wes brocht in difput this day befoir none, and the Moderator and Commiffioners of the Kirk being prefent in ane very great number, the Commiffioner, without any occafioun offerit be me, brak out violentlie in thir speiches, efter I had reffonit the point exactlie for his Majestie : "Be God, this man cares not quhat he speaks; for he fpeakes one thing to me privatlie, and evin now in my eir, and another thing publiklie, he is fo impudent." Quhairanent I made anfuer, and appellit to Sir Lues Steuart, quho hard us in the morning, and als to the Lord Privie Seill and Marques of Huntley, quho fupervenit efter.

17 October.

1 gaif in my petitioun to the Lord Commiffioner and Articles, defyring Sir Lues Steuart and the Lord Privie Seill and Marques to be hard to declair; quhilk petitioun wes red, but refufit to gif anfuer to it, and takin vp be him and putt in his pockett. And with this he fell out in the railling fpeeches contenit in the paper apart.

Item, this day, efternone, the newis cam of the defait of the Spanische Navy be the Hollanders, quhilk wes fochtin foirnent Downes Raid, on Fryday the 11 October.
